Création De fil en pétales inc. operates the website defilenpetales.com (called the « Site » from now on). The contract is composed of a legal agreement between the user and Création De fil en Pétales inc. Please read the terms and conditions of use carefully before navigating the « Site » of the online boutique.

By navigating the « Site » you are agreeing to be bound by the terms stipulated by the present contract, for as long as you remain on the « Site ». You acknowledge having read and understood these conditions. If you do not want to be bound by these usage conditions, you may not use the « Site » and order products or services. Those who choose to use the « Site » do so of their own initiative, and it remains their responsibility to conform to the applicable laws. Any claim made in relation to the « Site » and the elements composing it, or resulting from usage of the « Site », are governed by the laws applicable in the territory of the province of Québec. Confidentiality

All information provided during the order process will be kept confidential and will not be transmitted, exchanged, sold or rented to a third party. All enquiries made during the order are essential to identify the buyer and ensure a good customer service, personalized for both the transaction and delivery.

Pricing

The prices listed are in Canadian dollars and are subject to change without notice. The taxes applicable will come into effect during the transaction and the delivery charges are extra. The products can be purchased by credit or debit card directly on the « Site ».

Before we can start the creation of your flowers into pearls to form the jewellery, a down payment of 50% of the total purchase must be made. In case of cancellation, this amount will not be reimbursed. The pearls will be stored at our offices for a six month period. You may then prolong this period with minimum charges. Consult our FAQ for more information.

Delivery

The Delivery is made to the address provided during the order process. If the delivery address is different from the billing address, please indicate so during the purchase when prompted. The delivery fee is of eighteen dollars (18.00$). The delay for delivery varies depending on the destination. There is no delivery fee for gift certificates.

If the package is refused or impossible to deliver to the delivery address indicated during the order, or caused by client error while filling out the order details, the charges will not be reimbursed and the client will have to pay again for a new delivery in order to receive their package.

Restrictions of use

Apart from when indicated in one of the sections of the « Site », none of the elements of the « Site » can be copied, modified, distributed, published, translated, downloaded, posted or transmitted in any way, without the written permission from Création De Fil en Pétales inc. or the copyright owner. Downloading and posting elements of the « Site » are permitted, but only for non-commercial purposes without any modification to the elements. All unauthorized usage of said content may carry a civil legal suit and/or criminal prosecution.

Trademark

Trademarks and logos used or posted on the « Site » are existing registered trademarks or not of Création De Fil en Pétales inc. but from a third party. Nothing in the « Site » can be interpreted to allow, direct or indirect, use of a trademark replicated on the « Site » without written permission of the owner of such trademark.

Liability Limitations

Création De Fil en Pétales inc. is not responsible for any damage, including compensatory damage, direct or indirect, or any other damage of any nature encountered by the user or any other person, moral or physical; that it be caused by the « Site » or human or technical error such as the loss of network, broken communications, online computer systems, servers, computer equipment, software, data transmission, or any other technical difficulties or congestion of the « Site » or other.

Critique and Comments

You may note and comment on the proposed products on the « Site ». Before publication, these comments will be reviewed to ensure the legality of the contents, to prevent threatening, obscene, defamatory, that it does not affect the privacy of others, does not infringe any existing intellectual property, does not cause prejudice to any third party and is not objectionable, and does not engender computer viruses, or composed of political discourse, commercial solicitation, chain letters, direct mail or any form of spamming.

Création De Fil en Pétale inc. reserve the right to reject the publication of comments for any reason, (including those listed previously); they reserve the right to revise the comment for grammatical and spelling errors; without altering its meaning.

The critics themselves are responsible for their opinions and comments and do not necessarily reflect those of Création de Fil en Pétales inc.

Your account

If you are signed into the « Site », you are responsible for the confidentiality of your identity, your account, your password, to limit the access to your computer, and you are taking responsibility for the transaction effectuated on your account when prompted for your password. If the confidentiality of your information were to be compromised, please notify our service as soon as possible to avoid any fraudulent activity on your account. Création De Fil en Pétales will not be held responsible for any losses or damage as a result of non-conformity to the security measures listed in this section.

In addition, if you are under 18 years of age, you may not use the « Site » without the supervision of a parent or legal guardian. Applicable Law

The present contract on the conditions of service is regulated by the laws applicable in the province of Québec. Major Force

Création De Fil en Pétales inc. will not be held responsible for non-execution, for all or part of, these obligations towards you, or of any damage or loss you may be subject to, if non-execution, the damage or the losses result case of major force or circumstances out of their control.
